Guolee Obtains Dismissal of Construction Management Services Contractor
Querrey & Harrow Shareholder Terrence Guolee recently obtained the dismissal of a construction management company sued by an employee of a scaffolding contractor following an accident at a massive gas processing facility in Channahon, Illinois.
Following the accident where a scaffolding contractor's employee slipped and fell during the building of a scaffold, the plaintiff employee sued both the processing facility's owner and Terrence's client, which performed construction management services under contract with the facility owner at various parts of the facility. This work included working on the timing and permitting of the scaffold erection project.
Despite plaintiff's claims that the accident occurred due to an alleged failure to consider winter weather conditions and obstacles presented by the facility's adjacent gas processing tower, Terrence was able to impress on plaintiff's attorney that control of safety on the scaffold project was shared between the scaffolding contractor and the facility owner, rather than the client construction management contractor that was most involved in construction documentation work. Obtaining dismissal of the case saves Terrence's client from extended litigation and was obtained without the client needing to produce any of its management or employees for depositions.
